The work of Windsong Fencing Ltd. is guaranteed to be free of defects in materials and workmanship for a period of 1 year from the date of completion. If any of the work of Windsong Fencing Ltd. is found to be defective within the limited warranty period, Windsong Fencing Ltd. will, at its sole discretion, repair, replace, or refund, the work found to be defective. If there is a disagreement about a suspected defect, Windsong Fencing Ltd. will attempt to discuss the issue with the customer, and if an agreement can’t be reached with discussion between the parties, third-party professionals might be consulted, and arbitration may be used, to resolve the disagreement. The materials used in the work of Windsong Fencing Ltd. include natural materials such as wood, which has natural variation in color, texture, density, porosity, strength, and durability, as well as other natural variations in the material, manufacturing, and how it is processed before it is sold to us. Because of this variation, defects must be something abnormal for the material and must cause failure of the product to perform its intended function in order to be considered a defect. Wood contains moisture, and this can cause shrinking, expanding, and other distortion, which is not a defect. Pressure-treated wood is particularly prone to distortion, and such distortion, even when significant, cannot be considered a defect unless it causes the fence to detach or fall. This warranty excludes any incidental or consequential damages unless such exclusion is prohibited by law. If any workmanship or materials are/were provided by the customer, whatever has been provided by the customer is explicitly excluded from this limited warranty.
